A BILL to amend article ten, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twenty-two-h; and to amend article seven-a, chapter eighteen of said code, by adding thereto a new section, designated section twenty-six-t, all relating to increasing retirement benefits for teachers and public employees by fifty dollars a month.

Be it enacted by the Legislature of West Virginia:
That article ten, chapter five of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twenty-two-h; and that article seven-a, chapter eighteen of said code be amended by adding thereto a new section, designated section twenty-six-t, all to read as follows:
CHAPTER 5. GENERAL POWERS AND AUTHORITY OF THE GOVERNOR,

SECRETARY OF STATE AND ATTORNEY GENERAL; BOARD

OF PUBLIC WORKS; MISCELLANEOUS AGENCIES, COMMISSIONS,

OFFICES, PROGRAMS, ETC.

ARTICLE 10. WEST VIRGINIA PUBLIC EMPLOYEES RETIREMENT ACT.
§5-10-22h. Supplemental benefits for certain annuitants.

Beginning on the first day of January, two thousand four, as an additional supplement to other retirement allowances provided, any annuitant who is receiving a retirement annuity on the effective date of this section shall receive a supplemental benefit. Each annuitant shall receive as his or her supplemental benefit an increased annual amount of fifty dollars a month. Nothing in this or any other section of this code may be construed to require any appropriation of state general revenue funds for the payment of any benefit provided for in this section.
CHAPTER 18. EDUCATION.

ARTICLE 7A. STATE TEACHERS RETIREMENT SYSTEM.
§18-7A-26t. Supplemental benefits for teachers.
As an additional supplement to other retirement allowances provided, each annuitant shall receive a monthly total amount equal to fifty dollars.


NOTE: The purpose of this bill is to increase the retirement benefits of teachers and public employees by $50 a month.
